What Is Pollution Consent & Who Needs It?

Under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, every industry or factory that may discharge effluents, air emissions, or noise above permissible limits must obtain environmental clearances from the State Pollution Control Board (HSPCB in Haryana).

CTE (Consent to Establish) is obtained before setting up a factory or industrial unit. It approves the proposed design and pollution control measures. CTO (Consent to Operate) is obtained before starting operations, after the unit is physically established and pollution control systems are installed. Both are issued by HSPCB (Haryana State Pollution Control Board).
HSPCB categorizes industries as Red, Orange, Green, and White based on their pollution potential. Red category (highest polluters like chemical, pharmaceutical, tanneries) and Orange category (textile, food processing, engineering) industries require full CTE and CTO. Green category industries need simplified consent. White industries (very low pollution) are exempt from consent but may need registration. We determine your category and advise accordingly.
HSPCB typically processes CTE/CTO applications in 30-60 days for Green/Orange category industries and up to 90-120 days for Red category (which may require public hearing).
